CONSUMER TERMS OF SALE & DELIVERY OF YOUR ORDER

CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR
ORDER FOR FUTURE REFERENCE.
1.
Formation of the contract
1.1 These terms of sale apply to all goods supplied by artists unique
1.2 No contract exists between you and artists unique for the sale of any goods
until artists unique has received and accepted your order and sends you
confirmation in writing or by email to the address or email address you have
given. Once artists unique does so, there is a binding legal contract between
us.
1.3 The contract is subject to your right of cancellation (see clause 6 below).
1.4 artists unique may change these terms of sale without notice to you in
relation to future sales.
2.
Description and price of the goods
2.1 The description and price of the goods you order
will be as shown on the artists unique website at the time you place your
order.
2.2 The goods are subject to availability. If on receipt of your order the
goods you have ordered are not available in stock, artists unique will inform
you as soon as possible, and give you the option of selecting an alternative or
cancelling your order. Payment will not be taken until the goods are despatched
from artists unique.
2.3 Every effort is made to ensure that prices shown on the artists unique
website are accurate at the time you place your order. If an error is found, artists unique will inform you as soon as possible and offer you the option of
reconfirming your order at the correct price or cancelling your order. If you
cancel, artists unique will refund or re-credit you for any sum that has been
paid by you or debited from your credit card for the goods.
2.4 A delivery charge will be added to orders delivered to the UK
mainland. There may be an additional surcharge for deliveries outside this area
3. Payment
Payment for the goods can be made by any method shown on the artists unique website at the time you place your order. All goods must be paid for in
full prior to leaving our premises.
4.
Delivery
4.2 If there is no one at the address given who is
able to accept delivery of the goods, the carrier will place a card through
your letterbox to inform you that they were unable to deliver your order.
4.3 Every effort will be made to deliver the goods as soon as possible after
your order has been accepted, and in any event within 30 days of your order.
However, artists unique will not be liable for any loss or damage suffered by
you through any reasonable or unavoidable delay in delivery. In this case, artists unique will inform you as soon as possible. artists unique may deliver the
goods by separate instalments.
4.4 You will become the owner of the goods you ordered and responsible for risk
of loss of or damage to them once they have been delivered to you.
4.5 If the goods arrive by carrier and are obviously damaged you should sign
the delivery note as damaged.
4.6 Delivery's to none UK mainland addresses must be agreed through enquiry to artists unique first as pricing is strictly only calculated for UK mainland deliveries.
5.
Liability
5.1 Any glass breakages and shortages must be notified
in writing to artists unique as soon as possible and in any event no later than
five days from the delivery date, otherwise artists unique will not accept any
liability. Written notification of any other damaged or defective goods or any
incorrect quantities must be given to artists unique within 10 days of the
delivery date.
5.2 Once goods have been installed they cannot be returned unless faulty.
5.3 If you do not receive goods ordered by you within 30 days of the date on which
you ordered them, artists unique shall have no liability to you unless you
notify them in writing of the problem within 40 days of the date on which you
offered the goods.
5.4 If you notify a problem to artists unique under this clause, their only
obligation will be, at your option:
5.4.1 to make good any shortage or non-delivery;
5.4.2 to replace or repair any goods that are damaged or defective; or
5.4.3 to refund to you the amount paid by you for the goods in question.
5.5 Save as precluded by law, artists unique will not be liable to you for any
indirect or consequential loss, damage or expenses howsoever arising out of any
problem you notify to us under this condition, and artists unique shall have no
liability to pay any money to you by way of compensation other than to refund
to you the amount paid by you for the goods in question under clause 5.4.3
above.
6.
Your right of cancellation
6.1 You have the right to cancel the contract with artists unique at any time up to the end of seven working days after you receive the
goods (see below). A working day is any day other than weekends and bank or
other public holidays.
6.2 To exercise your right of cancellation, you must give written notice to artists unique by hand or post, fax or email, at the address, fax number or email
address shown below, giving details of the goods ordered and (where
appropriate) their delivery.
6.3 If you exercise your right of cancellation after the goods have been
delivered to you, you will be responsible for returning the goods to artists unique at your own cost and risk. The goods must be returned to the address
shown below. You must take reasonable care to ensure the goods are not damaged
in the meantime or in transit. The goods must be returned to artists unique in
re-saleable condition.
6.4 If you cancel your contract but artists unique has already processed the
goods for delivery you must not unpack the goods when they are received by you
and you must send the goods back to us at your own cost and risk as soon as
possible.
6.5 Once you have notified artists unique that you are cancelling the contract,
artists unique will refund or re-credit you within 30 days from receipt of the
returned goods. artists unique will deduct the original cost of carriage.
6.6 If you do not return the goods as required, artists unique may charge you a
sum not exceeding the direct costs of recovering the goods.
7.
Data protection
7.1 artists unique will take all reasonable precautions to keep the details of
your order and payment secure, but unless artists unique is negligent, artists unique will not be liable for unauthorised access to information supplied by
you.
7.2 artists unique will only use the information you provide about yourself for
the purpose of fulfilling your order, unless you agree otherwise. You can
correct any information about you, or ask for information about you to be
deleted, by giving written notice to artists unique at the address, fax number
or email address shown below.
8.
Applicable law
These terms of sale and the supply of the goods will
be subject to English law, and the English courts will have jurisdiction in
respect of any dispute arising from the contract.
9.
Events beyond our control
artists unique shall have no liability to you for any failure to deliver goods
you have ordered or any delay in doing so or for any damage or defect to goods
delivered that is caused by any event or circumstance beyond their reasonable
control including, without limitation, strikes, lock-outs and other industrial
disputes, breakdown of systems or network access, flood, fire, explosion or
accident.
10.
Invalidity
If any part of these terms and conditions is unenforceable (including any
provision in which artists unique exclude their liability to you) the
enforceability of any other part of these conditions will not be affected.
11.
Entire agreement
These terms and conditions, together with the artists unique website prices,
delivery details and contact details set out the whole of the agreement
relating to the supply of the goods to you by artists unique. Nothing said by
any sales person on artists unique behalf should be understood as a variation
of these terms and conditions or as an authorised representation about the
nature or quality of any goods offered for sale by artists unique. Save for
fraud or fraudulent misrepresentation, artists unique shall have no liability
for any such representation being untrue or misleading.
12.
Third Party Rights
Except for our directors, employees or representatives, a person who is not a
party to this agreement has no right under the Contracts (Rights of Third
Parties) Act 1999 to enforce any term of this agreement but this does not affect
any right or remedy of a third party that exists or is available apart from
that Act.
artists unique and Delivery of your order
Most
orders are delivered to your door within 72hrs but please allow 7-10 days just
in case. Wherever possible, we will notify you about any possible delays.
Deliveries
take place on weekdays between 7am
and 5pm and require a
signature. If you receive a card through your letterbox, please call the number
shown on the card to instruct where and when the parcel can be left (eg. with a neighbour) or when you will be home to take
delivery within a week or collect. Postage and packing paid will not be
refunded after 7 days of delivery unless the item is faulty.
Please inspect the goods thoroughly before accepting delivery and providing a
signature for receipt.
If returning goods please notify artists unique within seven days of receipt of goods, we will refund or re-credit you within 30 days from receipt of the returned goods. artists unique will deduct the original cost of carriage from the total sum that has been paid by you or debited from your credit card for the goods. If you do not return the goods as required, artists unique may charge you a sum not exceeding the direct costs of recovering the goods.
Specially commissioned work delivered as described and in good condition may not be returned due to the bespoke nature but if damaged in transit items will be exchanged free of charge or refunded.
All items returned to us must be received in a re-saleable condition.
